Can you expand upon or provide an anecdote of what one might expect if they had to disclose an arrest on their medical.

If it's your first alcohol related arrest or conviction and you registered 0.12 BAC or less, the AME will normally issue the medical. If he suspects substance abuse, he may decline to issue the medical and refer it to the FAA Medical Certification Branch in Oklahoma City for further review.

If you REFUSE a sobriety test, regardless of guilt or innocence, the AME must defer the decision to issue your medical to the FAA. The FAA will likely require that you submit to a substance abuse evaluation by an FAA approved doctor. If they deem that you are not an alcoholic, but have abused alcohol, they will likely issue you Special Issuance Medical. You will be required to carry the special issuance letter on your person and present it for inspection to an FAA official upon inspection of your pilot's certificate. If you do submit to a test and you blow more than 0.12 the same will apply.

If you are arrested, refuse the test, and subsequently found innocent or guilty of a lesser charge ( reckless driving) you will be required to undergo a substance abuse evaluation. The FAA deems a refusal as an admission of guilt with a BAC of 0.12 or more.

Bottom line.....DONT DRINK AND DRIVE. It's not worth risking your life and others. It's also risky to your career. If you have an issue and you want to discuss, PM me. I know a substance abuse evaluator that has a very good reputation with the FAA. If he thinks that you are not a drunk, he will fight very hard to get you a medical. If he determines that you have a problem....well, better start looking for another career.

I dont have any DUIs. Just been arrested for some some dumb sh!t 16 years ago. I never disclosed this and it was a misdemeanor.

I dont like to tempt fate, but I feel that if it wasnt disclosed on the next medical, I dont think the FAA will find out. I realize though, that if they do, its hot water for me. However, what is the expected outcome alternative to having this (an arrest) on your medical. What might the FAA do. This might require coun sel, I realize.
