It's based on Altitude. When you get above 9,000, they can clear you for a turn towards the departure fix. You have to cross over traffic at 8000 arriving over AML/ELDEE. You are well clear of P-areas by the time you climb through 9,000.
 
I actually asked Potomac departure that very question. His response was "Altitude is king"....
 
I noticed the engine out proc has changed as well from Aerodata. It has you joining up on the 341 radial till 2.6 dme from dca vor and then turn left to a heading of 310. I just wondering how close you get to p-56 on that 341 radial?
 
Careful... different companys and different airplanes have specific engine out procedures. ATC normally does not know that they are!!!
