If you're an employee and you are required to be at work for those hours then you must be paid minimum wage (with a few exceptions none of which cover CFIs). Check your state and federal guidelines, but normally it's based on the period of a week.
Is it worth the trouble of getting it fixed - probably not. Either your boss knows they are breaking the law and doesn't care, or doesn't know. I guess on the off chance they don't know you could sit down and discuss it with them with actual numbers to support your position - but I wouldn't expect anybody to be happy about it - I know my boss wasn't when I brought it up (but he did agree to keep paying the weekly payment to the CFIs .
