I have to hand it to you, you seem to have a keen legal eye.
Most people don't understand the distinction between what is right or wrong and what is legal. Additionally you have to consider the fact that the city, county or state procecutors are not going to care if you are a "nice guy" or just "in the wrong place". They are simply looking for a conviction rate for their resume', and most will run over who ever and whom ever to make sure it stays high, and they will use whatever wiggle room in the law to make sure it sticks.
But in cases like the above, I think the zeal is well worth it. There are some really creepy people out there, and the internet seems to have unlocked whatever box these people have been hiding in.
But along the lines of the thread, there was a case a few weeks ago where a high school teaching assistant that was 22 and just out of college got busy with a 18 year old high school student. Apparently they had met outside of the school. Hey, 18 is legal, right? WRONG.
State law in NC states that ANY sex between staff or faculty with a student OF ANY AGE is a felony despite the circumstances.

Looks like she may wind up with a sex felony rap at 22. Career over.
