Yeah but they certainly were missing the INOP placards on their foreheads, so they certainly were not airworthy, not matter what the weight

Well... their brain and rational way of thinking HAVE been known to be MEL'd from time to time (read MOST of the time). :D

Yeah, it's discrimination, The thing is, discrimination is not illegal. Ok, let's qualify that, it's only illegal to discriminate based on certain specific factors listed in specific laws. As pointed out by Andy Neil, these include veteran status, disabilities, sex, race, religion, and national origin. There may be some others too. There is no law anywhere which makes discrimination in general illegal. Employers are free to discriminate based on poor grooming, poor personal hygiene, previous accidents or violations, poor interpersonal communication skills, and a whole host of other factors, including whether the person is currently furloughed from an airline. If you don't think this is true, show me a law, any law, which prohibits discrimination against furloughed airline pilots.
