A five figure settlement is a payoff to avoid the expense and hassle factor of a trial. This was a strong eight figure settlement. 10 years of salary for all of ALPA's lawyers doesn't equate to the payoff here.

A five-figure settlement is a nuisance settlement in a small case. This wasn't a small case. This was a case that had the potential for a bad jury to award a truly heinous number. You never know what idiots on a jury are going to do (hence the original verdict). And although appeals would certainly fix a ridiculous number from a jury verdict, the problem with that is that in order to file an appeal, you have to put up as a bond the cash for the original verdict. So if a jury awarded $300 million, and you wanted to appeal it, you and your insurers and re-insurers would have to put together $300 million to post as bond with the court to be held in escrow until the appeal is completed.

So, when faced with that sort of situation, you start to weigh the pros and cons of a settlement. When the other side is insisting upon crazy numbers in the 100s of millions, it's not worth it to settle, because even the settlement will be difficult to fund. But when it starts to get down to manageable numbers, you have to take a real hard look at it to see if the risk of a bad jury is big enough to make the settlement worthwhile. That's all that happened here.

Idiots on a jury huh? Those would be our peers doing a civic duty. Can't call them idiots for finding ALPA responsible and guilty based on evidence presented. I know you think ALPA is holy and untouchable but the bottom line is in this case they screwed up bad. $53 million isn't enough after fees and such, but still the TWA guys deserve compensation for ALPA's failure. You are now SWAPA so you should let ALPA go or start a drive to kick SWAPA out and bring ALPA as the bargaining agent for SWA pilots.
