I was recently involved in a part 91 incident (no fault of mine but that is not the question) That evening there was no questions asked by the FAA or mgmt about taking a test, several days later I was told I should have filled the "cup" (which is in the airplane but I didn't know that) and taken a voluntary sample for my own protection. How could that protect me? I would be innocent of alcohol/drug use, but by not taking it they have assumed I used or could have used alcohol/drugs? Sounds like guilty until proven innocent to me.
 
My first thought after the incident would have been to arrange for representation, and produce a sample in order to document my lack of incapacity.

We are now in an incredibly litigious society. Watch your six.
 
I would be leery to whiz in a cup kept on the airplane. It's bad enough that the chain of possession is weak with most samples but to do it in a haphazard fashion in a non controlled setting is asking for problems. I would require written directions and a certificated administrator along with witness's to a jury rigged whiz test. Today like in the past, it's never the airline, owner or feds fault that a problem occurred. The pilot is the easy whipping boy. Don't believe a Union will back you either unless your from one of the chosen carriers, the FISDO/GADO might have actions on the burner and you can become cannon fodder for the real airline pilot negotiations.

Yeah, I agree, if you've got nothing to hide, go ahead and pee in the cup--but make sure it's under very controlled circumstances.

I used to be a lab tech and I can tell you, mistakes happen.
