If there are no slot restrictions why do they need to be "approved"? Regulation ended in 1978.

Virgin America plans to file an application with the Federal Aviation Administration (FAA) to serve ORD under the existing demand management rules at the airport
 
are they going to take slots from UAL and AA and give it to Virgin like they did with JetBlue?
 
If you have flown on UAL or AA recently you will know why they are worried about a new entrant on these important routes. I have flown both - UAL service is anemic and AA aircraft are worn and old-looking. JB offers a good product out of LGB in comparison to UAL and AA and VA should improve upon JB's.

I think VA will do very well on these routes because their value/price ratio is much higher.

So the same powers that forced AA and UA to trim slots from ORD are going to award those same slots not only to JetBlue, but to Virgin now?
