[FONT=ARIAL,]The Frontier Pilots Merger Committee members have brought a [FONT=inherit !important][FONT=inherit !important]lawsuit[/FONT][/FONT] in federal court against Republic Air Holdings and the individual Chairmen of the RAH Pilots Merger Committee, the Midwest Pilots Merger Committee and the Lynx Pilots Merger Committee. The plaintiffs allege "the Eischen Award is not fair and equitable within the meaning of Section 3 of the Allegheny/Mohawk LPPS" and that the Eischen Award "is null and void." When asked to comment, the RAH Pilots Merger Committee Captain Dan Sneddon stated, “FAPA believes the pilots of Republic, Midwest and Lynx have no right to integration with the Frontier pilots and it repudiates the arbitration award all parties agreed would be final and binding.

Below is purported summary of a lawsuit filed in federal court in Denver by the Frontier Airlines [COLOR=red !important][FONT=inherit !important][COLOR=red !important][FONT=inherit !important]Pilots [/FONT][/FONT][FONT=inherit !important][COLOR=red !important][FONT=inherit !important]Association[/FONT][/COLOR][/FONT][/COLOR][/COLOR] related to the recently awarded arbitrated seniority list (reposted from Airlinepilotforums):

Section 13(b) Dispute Resolution Agreement governs the process of devising a seniority integration via the processes of negotiation, [COLOR=red !important][FONT=inherit !important][COLOR=red ! important][FONT=inherit ! important]mediation[/FONT][/FONT][/COLOR][/COLOR] and then, if necessary, arbitration.

Section 13(b) conferred upon the arbitrator the authority to devise a “fair and equitable” seniority integration as defined under Allegheny/Mohawk.

Section 13(b) did not confer upon the arbitrator the authority to devise a seniority integration that is not “fair and equitable.”

Section 13(b) did not confer upon the arbitrator the ability to modify or limit any parties existing rights or obligations under RLA or existing CBA’s.

The FAPA Merger Committee sure is deluded. First, they take all the credit for stopping the buyout by SWA. (Yeah guys you completely single handedly stopped SWA from buying you. :rolleyes:)

Now this. Seriously, how more out to lunch can you be?
