By And Between
Continental Airlines, Inc.
And
ExpressJet, Inc.
And
The Airline Pilots In The Service Of
Continental Airlines, Inc.
As Represented By
The Air Line Pilots Association, International
Regarding Small Turboprop Flying
WHEREAS, Continental Airlines, Inc. (“CAL”), ExpressJet, Inc. (“XJT”) and the Air Line Pilots Association, International (“ALPA”) wish to provide opportunities for currently furloughed XJT and CAL pilots; and
WHEREAS, the opportunities afforded by this Memorandum of Understanding (“MOU”) create certain obligations and commitments that pertain only to CAL and certain obligations and commitments that pertain only to XJT; and
WHEREAS, the deployment of turboprop aircraft in certain Cleveland (“CLE”) markets may enhance CAL’s revenue opportunities; and
WHEREAS, CAL is in a position to make turboprop pilot positions at vendor carriers available for furloughed XJT pilots, including pilots who were simultaneously furloughed from both CAL and XJT (hereinafter collectively referred to as “furloughed XJT pilots”); and
WHEREAS, the parties recognize the importance seniority matters have for all pilots;
NOW, THEREFORE, the parties agree as follows:
CAL will provide, in its negotiations with potential small turboprop vendor carriers (“vendor carrier”) that pilot positions resulting from turboprop feeder operations into the CLE hub be offered to furloughed XJT pilots, in seniority order, subject only to objective employment qualifications of the vendor carrier that are no more restrictive than the qualifications applied to other pilots at the vendor carrier (e.g., minimum flight hours and ability to pass Federal security and drug screening requirements).
The acceptance or rejection of a pilot position with a vendor carrier by a furloughed XJT pilot, and the acceptance or rejection of a furloughed XJT pilot for employment by the vendor carrier, or the failure of a furloughed XJT pilot to complete training at the vendor carrier, will have absolutely no effect on any furloughed XJT pilot’s recall rights to either XJT or, for those with recall rights to CAL, to CAL.
Furloughed XJT pilots returning to XJT and/or CAL, regardless of whether or not they were employed by the vendor carrier, shall not be required to serve a waiting period in order to be eligible for health insurance coverage and such coverage shall be effective the first day of the month following the month in which they return to service at XJT and/or CAL.
Furloughed XJT pilots employed by the vendor carrier, other than those furloughed XJT pilots employed at the vendor carrier prior to the signing of this MOU, will be placed on the vendor carrier’s seniority list in XJT seniority order immediately following the last pilot on the vendor carrier’s current seniority list. This seniority placement will be used for all purposes, including monthly bidding, while at the vendor carrier. Furloughed XJT pilots employed by the vendor carrier shall resign their seniority number at such carrier upon their recall to XJT and/or CAL.
When a furloughed XJT pilot, who is flying for the vendor carrier, is recalled by XJT or CAL, that pilot’s release from the vendor carrier will not be delayed or deferred for any reason beyond the pilot’s recall date. The vendor carrier will grant the recalled pilot at least five (5) days between his/her release from employment at the vendor carrier and the recall date at XJT or CAL.
Compensation, expenses, and benefits will be paid from the first day of training at the same rate and benefit levels provided by the vendor carrier to its other pilot employees.
Monthly schedule and bidding for furloughed XJT pilots will follow the policies of the vendor carrier.
Should CAL desire to expand the use of small turboprop flying beyond CLE markets during such time as any of the currently furloughed XJT pilots remain on furlough, CAL, XJT and ALPA shall meet and agree on the provisions covering such expansion prior to its implementation. When the last currently furloughed XJT pilot is offered recall and returns to employment with XJT or CAL, or declines recall, this MOU shall become null and void.
By their signatures below, CAL and XJT each agree to the obligations and commitments
set forth above as related to each entity individually.
