TCAS and ATC disagree. what is your course of action? ( 2 scenarios : 1)you have TCAS I 2) yo have TCAS II

Anyone have a link to the mid-air that occurred in Europe a few decades back? The crews ignored the TCAS, followed ATC instructions, and smack! One aircraft was full of Russian kids and later one of the parents killed the air traffic controller. Crazy story.

Our flight manuals say the exact same thing that PoorJetDriver said.
 
TCAS I gives a TA only so the pilot decides the appropriate course of action and tells ATC if he needs to deviate.

Wasn't that long ago... maybe around 99/00? It was a Russian Charter and a DHL flight that was flying over swiss airspace, IIRC...
 
The Russian crew did not follow the RA, but rather the controller. The American cargo crew (DHL?) correctly followed the RA.
 
.. and the swiss controler was later stabbed to death by the parent of one of the dead children
