Ha - you really pull at the threads. Ken is retired.

He was the MEC Chair and is the representative of a group. A place marker if you will. Much like the suit marks the place in time needed to protect CY96 scope language.

Then he really shouldn't be a plaintiff, should he. Furthermore, senior CMR MEC Officers have also made sworn statements claiming "no harm" from DAL scope.

"Accordingly, because plaintiffs, by their own admission, are unable to
demonstrate any actual, demonstrable harm, much less any “causal connection between the
Union’s alleged misconduct and the outcome,” and further cannot show that Delta management
would have grown ASA or Comair even more than their business plans contemplated,
“plaintiffs’ fair representation claims must fail, regardless of whether the Union’s alleged
misconduct rises to the level” of “arbitrary, discriminatory or bad faith” conduct.​
