If a Navaid is notamed out of service but is tuned and identified to be working properly, can you use it ? Can ATC use it in a clearance ? Like if it is one of two navaids used in an arrival to the airport, can ATC issue you the clearance "..cleared XYZ arrival.. ?"

Heresay is good - opinions are good, but Im looking for hard reference to the answer...

No, if its NOTAMd out....there's a reason for it. I will say that sometimes the FAA Tech Ops (formerly know as Airways Facilities - they're the folks who maintain the navaids) guys within the FAA sometimes forget to tell us (ATC) that they issued a NOTAM. So, I would question the clearnace (if issued) and let ATC know there's an out of service NOTAM associated with the fix. On many occassions over the past 20 years, I have found out from pilots rather than through the correct means. We are all in this together. Share the knowledge.

I've encountered bad navaids (once in actual) that weren't NOTAM'd and reported them to ATC.
 
Plus, if you are in an airplane with an onboard navigation system, the fact that XYZ navaid is inop is irrelevant. Your system knows that XYZ is located at such and such lat/long, and will take you there, regardless of it is radiating or not.

For those with OpSpecs, see B034(c)(7).

Now, if your electronics are inop and youre filed as a slant ancient (/A), then you still could be vectored as if the navaid existed as long as you would still be in the operational service volume of the navaids that would form that intersection where that navaid is located.

In a lot of cases, an inop navaid will still be notammed as inop just because someone hasnt been able to check it (whether a flight check or not, I dont know); even when it is radiating just fine.
