I don't think they have much of a case but I'm not routing against them. Talk of the suit having any effect on the Nicolau list, however, is a guarantee to get ex-AWA pilots against them.I wasn't MDA but I'm routing for them.
I don't think anybody disputes the MDA pilots were ALPA so I wouldn't get too excited.My thinking here is that only members of a union can sue a union for a failure of DFR right? So if they get to go to trial doesn't that mean a judge agrees that they were members of the US Airways pilots union?
Again, I haven't read the complaint so I don't know how they approached the issue but suffice it to say in some ways they were mainline and in some ways they weren't. US Airways certainly operated MDA as a separate division.Ya I know the original intent was not to have it part of mainline but sometimes things don't go as planned do they?
