NYC lawyer sues Delta Air Lines for $5 million over delayed, stressful trip from Paris
NEW YORK (AP) -- A New York City lawyer is suing Delta Air Lines Inc. for $5 million, claiming the carrier's incompetence and indifference left him stranded in Paris for four days last October during an airport workers' strike.
Thomas Mullaney says Atlanta-based Delta refused to let passengers rebook flights by telephone and for "unfathomable" reasons insisted they go to the chaotic airport and rebook there.
Mullaney says he paid $5,000 for two round-trip tickets and Delta refused to reimburse him for the unused portion. He returned home on American Airlines.
Mullaney's lawsuit says he believes Delta stranded and failed to reimburse thousands of passengers. It was filed Wednesday in Manhattan and seeks class action status.

Delta spokeswoman Betsy Talton says she can't comment on pending litigation.

You really don't think he has a point? He paid $5,000 for a flight that was canceled and Delta wouldn't let him make alternate arrangements on the phone. They told him to come out to the airport with the thousands of other stranded customers and wait in line. And since Delta couldn't deliver the promised transportation he secured transport on AA and reasonably expects a refund of the unused portion of his DL trip. How is that unreasonable?

Sure, 5 million is a chunk of change, but you don't get a multi-billion dollar corporation to even look up without asking for big dollars. Without big damages it's cheaper for companies to continue their poor behavior like adding chromium to the water supply or ignoring roll-overs caused by incorrectly made tires. Consumers need to have a means to fight back.

I do agree that the lawyers end up with too much of the settlement, but they do take the risk of trying a case that can drag out for years with millions in expenses and possibly no settlement.

Class action lawsuits are a two sided coin. I bet you'd think no amount was too big if corporate malfeasance by a drug company or a automobile manufacturer injured or even killed a loved one.

And their JFK terminal is deplorable!! It is the most ghetto terminal I have ever even had the misfortune of looking at, as I taxi by on Alpha. They need to take a look at AA's and take note of a real terminal. They have rjs 1 on top of another over there and half the time theres a comair or freedumb blocking alpha waiting to get into that hell hole!

The old, early sixties' PANAM flying saucer roof blending in seamlessly with the hodge-podge of seventies' add-ons, forming the extremely aesthetically appealing architecture of an angular amoeba. The delightful exterior appearance only exceeded on the interior by the crush of pushy, aggressive New Yorkers cutting in lines and the confused, teeming masses of clueless third-worlders trying to find their gates! What more could you ask of an international terminal?

Commuting regularly on United and American, I can't say there's much of a difference riding in the back of any legacy. They've all got snotty kids, self-centered businessmen, brain-fried gate agents, and irritable flight attendants. Who cares.
