Our flying club is having a problem with our insurance. I'm hoping someone has an answer or can help us out.

We are based at an airport that also has a university flight training program here. Some of the aviation students in the university's aviation program are in our club and have been using our club airplane for flight instruction with a university instructor.

We have never had any problems for many years until a month ago when the university decided to change their insurance requirements for people who use their own airplanes. Their instructors can no longer flight instruct in our club airplane unless we meet some insurance requirements set by the university. One of the requirements states:

"The insurance carrier waives any right of subrogation acquired against XXX Aviation, Inc. or the State of XXX, their officers, agents, and employees by reason of any payment under such policies".

I've talked to SEVERAL insurance agents, including our current one, and nobody can help us out. I've tried Avemco-no luck. Anytime I say the words "Waiver" and "Subrogation" in the same sentence, every insurance guy just says, "Sorry".

Has anyone else had this problem with a waiver of subrogation? Any help would be appreciated!! Thanks.
 
Why can the university dictate terms to another entitiy? Can't the instructors work on the side for the club and not through the univerisity? Also, I'm guessing your one of the univeristy instructors, because the obvious solution to me is to cut out the BS and use non-university instructors.
 
I'm actually not an instructor for the university. The problem is that for the university students to get college credit for their flying, they are being forced to use university instructors. And the university will not allow their instructors to work "on the side". As much as the students dislike it, they are being forced to use only university instructors.
