Is that a Flight Options Legacy they hit?? Seems from the papers, its an american registerd airplane, and they are holding the pilots down there.
 
No, it was not a Flight Options airplane. It was a new airplane being delivered to a charter operator.
 
Merely speculation on my part, but might it be possible that the flight crew turned off the transponder due to erroneous signals? I cannot believe someone would be dumb enough to turn it off on purpose just to get a more favorable altitude or any other reason.
 
Possible involuntary manslaughter charges to these guys from what the wire says.

The pilots appear to be from a company in Long Island.

Hope it was worth it to F___ around guys. Turning off your transponder for any other reason other than being requested to is not in our best interest EVER.

Dude, it's just speculation that they didnt have their transponder on. Nobody knows for sure.....just wait and see what the facts are.

Wow. To posess this knowledge, you must have been in the jumpseat observing their actions. And since you were, why did you allow them to operate in this condition?

Lets just rename this the "Gol Accident in Brasil Speculation" thread. C'mon now, everybody. Pile on!

I know, this is first time anyone has speculated on this board. I hate to be the guinea pig. Let's see how it plays out.

But my theory is unfavorable winds and no experience in the region They were shooting as a direct flight form SJC to Manaus that is almost full capacity of the legacy tanks and I think the legacy max alt is 370 so they could not go to 380 to save gas.
Why they didn't accept Embraer pilots to deliver the airplane? Because they are a cheap company and probably presure the guys to pick up the airplane appealing to their egos.
 
Man the speculation happens FAST on this board. Great frind of mine works for ExcelAir. He is good friends with both pilots. Apparently they were in non-radar environment (suprise). He is saying that down there each tower controls a certain ammount of airspace around it. The pilots were cleared to be lvl at FL370. Another tower told the 737 to maintain block FL350-390. The VERY preliminary report is that the was a mis-communication between the 2 ATC facilities. As to the transponder not working, they are not sure wht it wasn't, since it was selected on, and not turned off. The ATC facility involved with the Legacy states that he cleared the Legacy to FL360 2 or 3 times and got no response. The pilots are stating the tapes will not back this up. Then again, if the 737 was block 350-390, 360 wouldn't have helped either.

Now, this is all 2nd hand thru my friend, but much more accurate than the speculation crap being thrown around on this board.

Confirmed?? By whom? Have you've read an OFFICIAL report of this accident? If so, please either post it or a link to it here.

I believe the certified ceiling on the -E model Legacy (which is now being produced) is 410. The conditions aloft may or may not have allowed for a higher operational altitude. But, we don't have these details - yet (see above).

The tone of the remainder of your post suggests you may have some personal issues with the operator of the Legacy. How do you know what type of operator they are? If I'm an operator taking delivery of a new airplane, my crews will do the acceptance and delivery flight, thank you. From what I've read, this seemed like a normal delivery flight. But until we have an OFFICIAL report, we don't really know anything other than a 737 came out of the sky and a Legacy lands in the same area with airframe damage.
 
I have extensive experiance in this area. Much of SA is non-radar, and many places are HF. They used to have procedures for In Flight Blind Broadcast (IFBP) along airways. Weather deviations can take you miles off course due to the ITCZ (Intertropical convergence zone).Things have improved over the years and IFBP has gone away but it is still very challenging flying with many sub standard operators from third world countries. I would hate to pre-judge anyone, knowing the operating environment they were in.

You don't have a clue. The distance from SBSJ to SBEG is less than 1500 miles, maybe up to 1600 if you figure lousy airway routing. That is well within range of the Legacy, even with a full load of pax. Weight for a trip of that length would let the a/c do an unrestricted climb well above FL370.
