You must put in a year before eligable for FMLA.
That's incorrect.

There have been many, many people who have taken FMLA leave in their first year. The actual wording of the law says "You must be an employee who has worked more than 1,000 hours in the last year".

Pinnacle actually tried to DENY people FMLA by looking back at people's schedules and saying, "Sorry, you haven't worked 1,000 hours" when, as pilots, we're RESTRICTED BY FEDERAL LAW from flying more than 1,000 hours in a year.

A quick trip to an attorney nipped that sh*t right in the bud. I'd personally liked to have taken the time anyway, let them fire me, then sue them for wrongful termination and violation of the Family Medical Leave Act. Several guys walking around out there almost $1 Million richer thanks to PCL management stupidity, would have been nice to be one of them.

For our purposes, FMLA is available once you have put in 1,000 DUTY hours, as the duty time IS compensated for in Per Diem. Keep track of your duty hours, it's printable each month in FLICA.
