Stayed tuned for the official announcement later today...

...however the gist of it is, FM is over. Delta must ceist and desist furloughing pilots (the final number is 1060) and must start a recall when traffic reaches pre 9/11 numbers (DCI traffic is included in this number) for 4 months in a row.
 
Item one. The System Board of Adjustment, chaired by arbitrator Richard Bloch, today issued a decision regarding ALPA's grievance challenging Delta's use of force majeure to justify pilot furloughs. The Board has granted ALPA's grievance in part. Most importantly, the Board found that negative economic conditions, rather than the events of September 11, were the principal cause of the Company's decision to continue furloughing pilots. Based on this finding, the Board ordered the Company to immediately cease further furloughs. Consequently, the announced March 2, 2003 furlough of 20 pilots has been cancelled, as we reported last week. However, the Board declined ALPA's request to order a recall of all furloughed pilots. Instead, it required Delta to recall furloughed pilots at the point that Delta system-wide RPMs during any four-month period equals or exceeds the RPMs for the same four-month period immediately prior to September 11, with certain RPM adjustments. At that point, all pilots still on furlough and protected by the no-furlough provision are to be recalled on a schedule dictated by the standard training process. For this purpose, system-wide includes Delta and all Delta Connection flying. ALPA will monitor the appropriate data for determining whether the recall process has been triggered. ALPA is pleased that the System Board has agreed that management cannot continue the furlough of Delta pilots. While we are disappointed that there is no immediate recall of currently furloughed pilots, we are also pleased that the ruling provides a mechanism for returning furloughed pilots to the cockpit, and that this method does not depend on management decisions.

As an aside, since ASA & CMR (not to mention the others) are "not integrated" in ALPA's view, it is interesting that the arbitrator has included DCI RPMs in the calculation.
 
Someone out there smarter than me know how this will affect ASA & CMR expansion plans and hiring?

This is a loophole that management can utilize by manipulating the RPM's system wide.

I believe the judge interpreted that the growth of DCI was at the expense of mainline and placed a mechanism in place , RPM's, to restrict Leo from continuing this strategy. However, who is to say that Leo doesn't manage the system wide RPM's of Delta to prevent the recall of the mainline pilots.

It is safe to say that there won't be any recalls for the near future--6 months or so, and then the rate of recall is pretty much up to the company---under a "normal training cycle"---whatever that means. We are retiring a large amount of senior pilots due to the USAir pension problem. Every time you take one senior guy off the top, something like 10 upgrades occur----MD-11Capt goes to 777, 767ER Capt goes to MD-11 (Yes, we will eventually park them, I know--but after CRAF), 767 Domestic Capt goes to ER, all the way down to 737-200 FO going up to 737-800 or MD-88 FO. It is a huge training cycle. I moved up 60 numbers in December alone, and 25 last month. Some of those numbers were from guys bailing out. Let's hope it continues!!!

FWIW, my predictions how Leo will still get what he wants.


1. He will now come after DALPA for huge concessions in line with UAL and AAA. If they continue to refuse, look for the Chap. 11 lawyers to come out in force.

2. Since the RPM's include mainline and connection, he will use the argument to increase regional flying to bring more mainline pilots back and fight hard to have the block hour ratio renegotiated. He will start infighting amongst senior and furloughed pilots by holding them hostage to connection flying.

3. If all else fails directly link every lost job, every frequent flyer perk that disappears and every drop of the stock to the pilots HUGE wages and their refusal to help the company for the good of the WHOLE Delta "family". I hope the pilots have good auto insurance.


It will be interesting to see which (if any) of these will happen. Anyone else with thoughts, comments ?

Are these guys getting out early? I.E. 50-59 year olds? Or is the number just normal retirements. I was told that there would be arround 500 per year for the next few years which is good for the 1060 furloughed guys. But you seem to be moving the normal amount of around 42 per month. If more individuals are getting out early, could be even greater news for the furloughed guys as they could be back much sooner than originally thought.

But my thought on this is that management will use this as a natural way to reduce the size of mainline. They can wait for the normal retirements to happen and just not replace them. When the 4 months in a row occure, Delta only has to bring back 1060 guys but can still reduce the size of mainline. Any thoughts on this?? (from anyone). :confused:
 
I'm suprized that there is nothing posted here (that I can find) about Delta's MEC chairman refusing to talk to the company about pilot pay cuts. It was in the USA Today yesterday. Of course, I probably worded this wrong. He didn't really "refuse," per say, he gave a statement instead. I'm sure someone here will be quick to correct me. Thanks!!
