One thing to add: I don't believe there's anything prohibiting your employer from using CVR data against you at any time. The FAR's only place restrictions on the FAA's use of the CVR.

Some airlines have protections written in their CBA's (pilot contracts.)
 
The law says things one way, but then the Feds say what they want.
I don't know how confidential these things are despite ALPA rules and CBA and stuff, because I can look up the tapes of almost every major airline disaster in a long time and hear the CVR tapes.(grim stuff)
