You've got the percentage backwards. The company may limit HBA participation to 30% of the seniority list, not 70%. According to the contract, the participation level may exceed 30% because of grandfathered pilots (i.e. pilots on the seniority list prior to ratification) using their rights to HBA. A new-hire will have to wait to reach the UPPER 30% of the seniority list, according to the current contract.
If you go to the ibt1108.org website and want to read the language for yourself, check Section 13.1(b). The contract, by the way, can be found by clicking on "NetJets Pilots", "Info for New Hires" and then selecting "Contract".
