Finding a Safety Pilot

No need for flyers, just ask any CFI that wants to move on, but needs hours. They would be stupid not to go. Ensure that they know that you are just looking for a safety pilot, not dual instruction and that they would not be getting paid.

The CFI idea is a good one. However, I wouldn't call a CFI stupid if they expected to be paid for giving dual instruction, which is exactly what they will be doing as "safety pilot."
 
don't you know any other private pilots out there? what about where you're learning to fly? there are no other students there w/ a license to go up with you?

Don't bank on it Troy. When I was a CFI i charged for my services and thats the way most CFI's operate. You may whore out the profession yourself but most CFI's will expect to be paid.

Well, not exactly..."holding out" is one of the things that MAKES it a commercial operation. No money need change hands for the FSDO to call it a 135 operation.
Depending upon how the flyer is worded, and whether they actually land at another airport, I could see how an FAA inspector could twist this into "holding out". They could say that the safety pilot is "paying" (with his safety pilot services) the guy providing the airplane to go somewhere, which WOULD be a 135 operation were it actually the case. The fact that you're willing to use anybody (remember, you're putting up a flyer for everybody), rather than someone you normally fly with, would support this reasoning.

135 violations have been built on not much more than this, unfortunately.

Commercial Opperation.

Consider this.

Safety Pilot is a 'Pilot in Command' privilege, as such, should the safety pilot not be commercially rated that pilot must pay at least the pro-rata share.

If the Safety pilot is not paying than the safety pilot is opperating commercially. If the safety pilot has anything to do with obtaining the plane than the safety pilot is charter.

Man! this stuff is rough!

Also the safety pilot being able to log the time could be considered compensation.




I know from Experience! I posted a flyer at 2 FBO's I got a call while driving with the wife 2 days later Guess who????? Ring, Ring, Hello, I here your looking for a safety pilot, I said yes - well this is so & so with the FSDO just a friendly warning Posting a flyer is considered holding out I asked what’s holding out was a private pilot did not know the Fed Explained and told me it needs to be in passing & word of mouth.
 
Probably someone, somewhere, used "safety pilot" as a ruse to actally carry a pax point A to B. That's sad. First I've heard of going after safety pilots.

My understanding of this specific instance is that they're going after the guy trying to keep instrument current...he's the one that posted the flyer, and "holding out" applies to the guy "advertising", right?
