This is a bad precedent:

"The jury Thursday ordered Executive Jet Management to pay Streeter $10 million for negligence and custodial interference. Jurors then awarded her another $17 million for the 22-months she spent apart from her two kids.

"She was certainly thrilled with the result and hopes that it sends a message to the private charter industry," Streeter's attorney, Barry Pollack, told the Associated Press."

What message would that be, counselor? Are we expected to interrogate our passengers as to their intentions on a given trip? Do cabbies have to ask their passengers if they are doing anything illegal everytime they pick up a fare?

I wouldn't spend that %33 just yet Mr. Pollack, I have a feeling this one will get reversed.
 
Im willing to bet they will appeal.

It was in jury trail so emotion was a factor. Didn't they make a movie on this?

The sad thing is, this case could have happened to an airline, a stand-alone charter company, or even a cruise ship line. I'm betting EJM caught the suit because a lawyer saw the EJM-Berkshire Hathaway connection and felt that he could get a payout from a jury for himself and his client (and in that order).

If this is upheld, the ramifications to the transportation sector are mind-boggling.

It just means that every tom suzi and upset wife will start law suits about every time we fly someone across state lines. Just wait and see. It will be appealed as the insurance company that holds the paper with EJM will fight this and soon be joined by others in the industry when the lawsuits start pouring in.
 
Really bad precident

God forbid a single parent gets invovled in this whole fractional ownership thing and wants to take their kid on a trip to Disney World.

People are so f---ing stupid.

You've done a fine job baiting the fractional pilots.

Get some time and understand that a letter is required when you leave the country.

Maybe I've had too much to drink tonight....or maybe it's just not speicfied otherwise...but I didn't see anywhere that it said that they left the country...?

Yes, I read the AIN email that detailed this....but I didn't pay much attention to the details. Where exactly did they go?

I should have been more clear in my comments. I don't have the article in front of me at the moment, so I'm going off of memory here. Please excuse unintended errors. The fact that a mother can sue the company for negligence doesn't sit well with me. The fact that the jury awarded her money does not prove that the company WAS negligent, it just proves that the lawyer was able to spin a really good sob-story that tugged on the hearstrings of the many sympathetic jurers sitting in the box.

Reading about this lawsuit made me think of the the accidents in which the pilot gets killed because he/she made a bad decision. Not because there was a problem with the aircraft, systems, instruments, blah blah blah. The pilot killed himself because he/she was stupid. Yet, the family sues the radio manufacturer and wins money. We all know the radio manufacturer had absolutely no influence on that pilot getting killed. The pilot died because he/she **CENSORED****CENSORED****CENSORED****CENSORED**ed up. Why did the family win money? Because the people in the jury are ignorant to the realities of the situation. Everyone knows the radio manufacturer didn't cause the accident. And yet money continues to be paid out for frivolous reasons.

The above is an obviously extreme example of the unfortunate truths of our wonderful and letigious society. I suppose it would be important to admit that I am rather cynical when it comes to stories like these, and automatically assume people initiate lawsuits for frivolous reasons. Unfortunately, there are legitimate reasons to bring forth a lawsuit, but they get drowned out by the idiots. Which is why I say people are f---ing stupid, especially when dealing with mob mentality.

I realize this subject could be delved into much much deeper, but I hope I've at least clarified for you a little what I originally meant.

Thats a State record for jury awarded payout in Conn.
