Is the key word...

As far as the law is concerned and your driving record it never happened.

Q: If my record is expunged, do I ever have to admit that I have a criminal record?


  • A: In most states, and with some limited exceptions, after your records are sealed or expunged, you may truthfully say that you were never arrested, charged, or accused of a crime. In the eyes of the law, the entire incident never happened. In most respects, a sealing or expungement restores you to the status you occupied before being arrested or charged. You should be aware that the federal government doesn't have to honor the expungement, nor does an expungement of a conviction necessarily relieve a person from having to disclose it in an application for public office or on some professional license applications.
 
Honesty.

Own up to it. Discuss the mistake you made and how you learned from it. You've paid society back for the wrong you committed. There is no sense hiding it and stressing all the "what ifs".

Or don't say anything at all, hold you breath, and hope nothing goes sour.

A recent application I just completed made special attention to this matter, demanding the info even if expunged... by not revealing the info, you would be lying on the application, which is cause for termination...

Be honest as expressed above.. its a test to see into your charactor..
 
The FAA medical application was revised about a year ago. On past applications, you were only required to report a conviction for an alcohol related offense, suspensions, revocations, et al. Now you must report an arrest or conviction, even if the arrest resulted in dropped charges, expungement, etc. The FAA will find out. Report it. They will throw the book at you if you evade the arrest question and they uncover the record on their own. If you report it, you might have to jump through some medical hoops. PM me if you want to know what hoops....

As far as Canada goes, they are only interested in convictions. If you have an expungement, then you are good to go. No worries there.

Be honest on the interview. Don't go through training whilst looking over your shoulder. PM me if you need additional info. Good luck!
 
Report it, and do the dance. They will find out, sooner or later, if they don't already know before you interview. Most employers do a thorough background check that starts even before you interview. Even if for some reason it does not show up initially and you are hired, if it is discovered in the future, and you did not report it, you can be fired years later for falsifying your application.

The one last thing to consider, is that someone else in your personal world knows about it. There have been wives who become former wives, spurned girl friends, hostile in-laws, neighbors, former friends, and former employers that have spilled the beans in malicious, retalitory reportings, years later. If it becomes known, even after lengthy employment, even with union representation, you can and most likely will be terminated, without a chance of legal challenge.

As a former poster said, admit and present it in a positive way that you learned and changed as a result. There are still people that get hired because they were honest, humbled, humiliated, and remorseful in their forthrighness.

as a side comment I would add that a person can be arrested at any time without evidence. I personally know people that were arrested for DUI without a breathalyser. Those charges were dropped, of course, but an arrest record remains. This is why we have due process, to protect us from stuff like this.

Thanks for the replies! I was asking on behalf of my brother. He's gonna be honest and go from there no sense worrying about it after you get hired. And yes not that its any of your business but he was pulled over the next morning after being out and was over the legal limit still so be careful everyone even know ya slept if off for a while.

A. It was a joke.

B. He asked the question and made it everyones business.

Why do drunk drivers get so much sympathy anyway? Drunk drivers kill people. Ever know anyone killed by a drunk driver?
 
Just make sure you have an answer when they ask you have you EVER driven drunk since then? Don't look down, scratch your face or touch your hair when you say NO.
 
the best path is honesty, disclose it. It might prevent you from getting an interview at first, but when the flood gates open you will get the interview and I dont think they will have a problem with it if you are honest and it is a one time thing. An airline like delta will find out about it no matter what you put down and its better to be honest then to be pulled out of training. We all have a past and no one is perfect but those of us who dont have a spotless record may have trouble getting interviews at first becuase of the extreme competition, but be persistant and go to job fairs and meet people and let them see a name with the face, not just a check mark on the dui box.

Apparently until it was expunged, It was public record, which means it is your business if you so choose.......touchy little bugger, aren't you?

Even if you blow a legal number, even 0, you can still be arrested. It's all about what the cop thinks at the time. Happened to a friend and she was convicted even though she blew a legal number. Total mess. I highly reccomend that everyone do a little research on your rights when you are dealing with the cops. There are things you can do to protect yourself if you know your rights.

Can you expand upon or provide an anecdote of what one might expect if they had to disclose an arrest on their medical.

That question, if on an airline application, is likely illegal. Employers can only ask if you were convicted of something. If legally you weren't, I wouldn't disclose it.
