But ATSG has a leasing company. All Hete would have to do is transfer aircraft from ABX over to the leasing side of the house, then lease the aircraft out to another carrier.

Not sure if your scope clause would cover that scenario.

That would fall under the part of the scope that says these aircraft connot be flown by a sister company under the ATSG umbrella. Nothing would prevent them from being leased to someone not under the ATSG umbrella.
