Either way Mesa will only lose with this deal. It could be hard for Delta to get 100% of what they're asking in court however Delta is Mesa's employer. They can fire them whenever they'd like even if it means a payoff. Delta is not going to wait forever and they already have waisted time these last several months, JO will have to find a home for those 34 ERJs. I'm not exactly sure what the financial status is on those planes.

Maybe JO is looking for a "creative" accounting firm to help sell his snake oil to the courts and to make Mesa look more attractive than it really is. Of course, this may mean that when Mesa does fail, it will fail in dramatic fashion.

Arthur Andersen was the accounting firm for Enron! That is what drove them out of business.

No, more than likely the switch to D&T was a stipulation of the Bondholders deal - the Bondholders are more or less buying Mesa as they will now hold a vast majority of the outstanding stock.
