Delta May Have to File for Bankruptcy

ATLANTA - Delta Air Lines said Monday that it may have to file for bankruptcy if it doesn't get significant wage cuts from pilots, the first time the struggling carrier has publicly linked the two issues in a regulatory filing.

The Atlanta-based company has said repeatedly that it would fight to avoid bankruptcy and has been cautious in the words it uses when discussing the possibility. Asked about it at Delta's annual shareholder meeting last month, chief executive Gerald Grinstein said only that bankruptcy would be undesirable.

But in a quarterly report with the Securities and Exchange Commission (news - web sites) on Monday, Delta said in part: "If we cannot achieve a competitive cost structure, regain sustained profitability and access the capital markets on acceptable terms, we will need to pursue alternative courses of action ... including the possibility of seeking to restructure our costs under Chapter 11."

Spokesman Anthony Black said that while it is the first time such language has been used in a public filing, Delta has not changed its position. He also noted that Delta is seeking to reduce cuts beyond pilot wage concessions, including through increased productivity and customer service improvements.

"It's an option," Black said of bankruptcy. "It's not anything we see in the foreseeable future, but it's out there."

Shares of Delta fell 35 cents, or 6.5 percent, to $5.03 in afternoon trading on the New York Stock Exchange (news - web sites).

Ray Neidl, an analyst with Blaylock & Partners in New York, said the language in the filing suggests Delta is guarding itself and making sure it warns people about the possibility of bankruptcy. He said the key to Delta's survival is clear.

"It's strictly dependent on the pilots," Neidl said. "They can avoid bankruptcy if they get the cost cuts. If they don't, they'll have to go into bankruptcy."

A spokeswoman for the pilots union could not immediately be reached for comment.

The company is seeking a 30 percent pay cut from pilots, who are offering only 9 percent and to forego a 4.5 percent raise they were to have received earlier this month. Talks have been on-again, off-again over the past year.

Delta, the nation's third-largest airline, has lost more than $3 billion and laid off 16,000 employees in the last three years. In the first quarter, it lost $387 million.
 
Of course there is scant criticism of management for their "all or nothing" negotiating tactics. Or the handing out of exorbitant "retention bonuses", followed by high turnover and lackluster performance.

Hey, I'm just posting the news as they report it...

The way I see it, it's not the pilots' fault that Delta management negotiated in bad faith. Holding out for 30% paycut while still paying premium pay for 2 years is borderline criminal in the eyes of the shareholders as that kind of an attitude is what brought Delta to the brink of bankruptcy.

The idiocy of some airline managements never ceases to amaze me...

BullSPIT! This Neidl guy is a management puppet... Sure, the pilots are to blame about everything all the time. CURSE those DANG pilots!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Neidl should know that management's cozy, secret bonuses and BONEHEAD fuel hedging strategy sure didn't help much... Kinda sent the wrong signals.

The DAL pilots have already indicated that they would negotiate wage cuts - that's a given. But wait..... shouldn't someone reveal an actual PLAN before wage cuts are agreed to? DON'T THAT MAKE A LITTLE SENSE????????????????????????????????

This is becoming a laughable situation. The pilots have come to the table to begin negotiations and management is STILL stalling. How about coming up with a decent plan first? Maybe that GENIOUS Neidl could come up with a good plan besides just cost cutting like Siegel...
 
Three points

One - I would not want negotiate against a 72 year old CEO. What does he have to loose?

Two - The Delta pilots have to realize their war is no longer with management but rather the consumer. Natural market forces are now driving prices. The longer they wait the more painful the cuts.

Three - What happened under Ron Allen, Leo Mullin, etc. is really irrelevant now, it is time to save jobs and protect the lifestyle somewhat. Bankruptcy is not good and should not be viewed as the solution. Bankruptcy is used as a weapon now.

Remember, if Delta enters bankruptcy, all of the DAL-family pilots (including ASA and Comair) could be subject to wage cuts... Why shouldn't DAL management also try to reduce Comair and ASA pay while it is under the "protective umbrella" of bankruptcy? You bet management will go for that....

DAL pilots are already sitting at the bargaining table. DAL management is stalling. Do not expect any serious consideration until a PLAN is formulated and discussed.... The fuel crisis is not the pilots' fault. Poor hedging strategy is management fault. Sure, it is time to cut costs, but management is giving up a lot RIGHT NOW by not sitting at the table to start negotiations - the pilots are ready... It's time to negotiate vs. wait around and continue to bleed the company...

l'm sure General Lee is on a trip - I'll bet he flips his lid when he sees this crap...
 
The Delta MEC has been willing to negotiate a reasonable package for some time now. Management has not come to the table to negotiate they have come to the table to demand voluntary concessions similar to those we would receive in BK. Luckily for us, we have some of the best industry analyst monitoring the company books. They are top notch and can read the books faster than the company can cook them. The Delta pilots are willing contribute what is required, but we are not willing to concede what is wanted. Management wants to reset the value of an airline pilot career and the expectations of airline pilots industry wide. We are willing to negotiate, but only for what is needed . DAL can not be saved from bankruptcy, nor driven into it by the 12% of employees with a contract. Grinstein is playing hardball and creating an atmosphere of fear and desperation is part of that game, but we aren't playing. I'll listen to my economic financial analysis team and my MEC, if the company wants to negotiate a relief package the company knows where to find them, they've been ready to negotiate for quite some time now. Maybe when Grinstein gets a clue about what plan he has for the company he'll be more inclined to negotiate, but as long as he has no plan, I doubt that we as pilots can make up for the failings of our management team.

This is GREAT management PR at work. Haven't we heard this before? It's the same old story - threats, threats, and more threats. How about a plan, plan, plan?

Not much has changed because we have heard this before - I bet before some BONEHEAD altered the Delta fuel hedging strategy. Good job on that one management genius! I am sure your shareholders appreciate that great decision. Who got a bonus for that one?

I give credit to the Delta pilots. They have a reasonable union (IMO) and are willing to negotiate in good faith.

It's unfortunate that Delta management will not do the same.
 
Guys......

Things are going exactly to Delta's plans. They NEED to file BK so that they could get their Aircraft leases down, Gate spaces renegotiated, Pilot Contract cuts...etc.... I could go on and on and of course they play the "its the pilots fault" game. Alot of the flight attendants are showing some serious animosity toward the pilots, because they are told that its the pilots fault in training and recurrent. Add the fact that ALPA will NOT combat this in the media for some unknown reason and you have yourself a new restructured company with alot lower costs and thank god for management being there to get things back to normal. These guys are good at doing things like this and hence the reason why unions are a necessary evil.

Its also funny how people on this board cut down pilot groups for taking pay cuts or not holding out for a better contract and yet when the delta pilot group stands their ground they still get ripped on........you guys kill me !!!!!!!!!!!!!!!!!!!!!!!!!
 
Delta Paycut

Well, it looks like I lose again. The first time was when Delta reneged on the Pan Am takeover and the second was whenI bought a couple of thousand shares of DAL thinking the Delta Pilots would get serious, grow up and take something resembling industry standard. It was a bad bet! They insist on playing chicken. I can't believe the arrogance and greed out there....typified by guys like the General...... Anybody who has spent much time in the military would know it was an insult to run around calling yourself General. Why is it the non-military guys like fighter planes as avatars and military rank? gggg

Didn't Delta just have a gate met that triggered a recall of all their furloughed pilots? I bet that will put a dent in their balance sheet.
