I'm just telling you that there is a difference between civil and criminal court.

I can sue you...but I cannot criminally prosecute you. Big difference. I can swear out a statement to police or a prosecutor and the prosecutor may decide there is enough evidence to ask a judge to hear a case...but an individual or a corporation doesn't criminally prosecute a case.

I think they are leveraging against us because of the evidence we have against Jock Sherock or whatever the fug his name is and the others on their participation in stealing from the "food for oil" program.

But you know what...we don't freaking negotiate!!!

That's what I think this case is all about...getting even or holding us for ransome over the other thing...it don't take much of a correlation to see that.

Looks like they should be suing EELEESHIA for not wearing her seatbelt.... Dat's ok...the city's got big money! Also, read vewwy wewwy cawfully...it's a civil suit filed by the family and a criminal complaint against the driver by the government.

Man involved in fatal crash is suspended

MILWAUKEE - A man who lost a mattress from off of a trailer on Interstate 43, resulting in a crash that killed a woman, is a Milwaukee County employee who was using a county-owned trailer when the accident occurred, records show.

County parks director Sue Black said William Schmitt, 53, of Wauwatosa was suspended without pay from his job Thursday pending a Personnel Review Board hearing on the matter.

Schmitt, a painter with the parks department, told investigators he was using a county trailer to haul furniture to his vacation cabin in Langlade County when a mattress fell out of the trailer onto the northbound lanes of I-43, according to an Ozaukee County Sheriff's Department report.

Elise Misuraco, 36, of Milwaukee, died Dec. 12 after swerving to avoid the mattress and being thrown from her vehicle.

Black said she was investigating Schmitt's claim to investigators that he used the trailer with his supervisor's permission.

Schmitt received two traffic tickets -- for not reporting the accident and for not properly securing his load -- with forfeitures totaling $424. He has pleaded not guilty to those citations. He has said he was not immediately aware he lost the mattress, or of the accident.

Chris Stawski, the Misuraco family attorney, said it is likely the county will be included in a wrongful death lawsuit and that a notice of claim against the county, a precursor to filing a lawsuit, would likely be filed within the next month or so.

Robert Andrews, a deputy corporation counsel for Milwaukee County, said the county had been verbally informed it may be a defendant in a lawsuit arising from the accident.
 
First off I did not read all the posts on this tread. The DC-10 has to have to oil checked before the flight (I think) or something in the engine that is required by an AD(maybe). This has to be preformed by maintance. Well Air France is or was contract MX for CAL over there. So it should be the mechanics fault for not replacing the shim back. It was a shim that went between a clamp to hold the cowling closed to prevent ware. It came out of where ever the mechanic placed it on the runway and caused the crash. I'm not en expert on the DC-10 or a mechanic. This is what I have hear b/c I worked for CAL at the time.

How do you figure leaving metal objects on a runway is an accident? I'll buy "negligent act". Whether it was a design flaw or a lack of inspection or reasonable care by the maintenance department...you can’t fling debris on runway and expect not to be hauled into civil court.

Do they not have Airfield Managers in Europe? Did they not inspect the airfield on a regular basis to ensure the airfield was clear of debris? We do in the US. On average every hour at a major airport.

France is oversimplifying the issue. There are many causes, including the poor design of the Concorde's belly. To attempt to put all of the blame on CO is horse crap.

do you really expect the French can find a small piece of metal on a runway (if a runway inspection was to be done) when they can't find something as large as a suitcase?

I find nuts, bolts and tools all the time on the runway from aircraft. Most found at night.

Wow, I have never heard of this story.

That is really scary. I dont know what the he!! is wrong with those French. I would be pissed as all heck if they planted explosives on me. Knowing the French they would plant explosives on an American Tourist and then accuse him of being a terrorist.
 
Right now, someone's kid is making animals out of the block of clay that their parent forgot that they had bought....
