When does a normal procedures checklist have to be certified by the FAA?



I interned at a company that did part 91 and 135 flying, and they had to have the checklist that they made up certified by the FAA. Is that just a part 135 reg? Or is it a “transport category A/C” reg?



If my flight school wants to make a normal procedures (Preflight though Shutdown) checklist, for part 91 flying (Instruction under 141 & 61) does it need to be FAA certified.

pretty sure thumbing through 135 stuff a while back, I noticed requirements for checklists...could be wrong though.

If that was the case and it was 135 stuff I was looking at (may have been 141 or both even) then I'd assume they need to be approved.

i believe for 141 schools it has to be certified by the faa...

part 61 its whatever you want...
 
Part 135 they have to be accepted, 121 they have to be approved, it seems to me that I recall 141 having to be accepted... been a long time ago. Reason I say this is because I remember we tried to make our checklists a little more user friendly and never could get them through... basically if they didn't match the manufacturer's checklist, the inspector wasn't going to sign-off on them. When I did the same thing under 135, no prob... different inspector though. Go figure.

Clutch Cargo is correct. 135 doesn't need "approval", just needs to be accepted. Electronic Checklists have different requirements per an AC. Not sure about 141, but I would think that checklist requirements would fall under 91 regs.

141 does have to have a stamp of approval from the local FSDO. As long as you include at least the same items that the manufacturer's POH/AFM contains, then the FSDO shouldn't give you a hassle. For part 91, you can use whatever you want. Just make sure you don't leave anything important out. :)
 
There is no Part 91 FAR requireing the use of a checklist. You can use anything you want. That's what GUMPS is - a part 91 made up checklist.

Part 141 schools are at the discretion of the local FSDO POI. The 141 regulations are very general in nature and tend to be "interpreted" by the local POI's who are primarily ex-military or airlines, so if you ask them, they will think that they have to "accept" or "approve" as they do in Part 121/135 ops.

FAR 141.75 Aircraft Requirements: "The following items must be carried on each aircraft used for flight training and solo flights:
(a) A pretakeoff and prelanding checklist.
(b) The operator's handbook for the aircraft.

Most inspectors are happy with the manufacturer's checklist, or a copy from the POH, but it is ok to make up better, more user friendly, better training checklists, as long as the POH items are included.

Of course, it depends on your local FSDO inspector, but you can see from the regulation that the checklist does not have to be "approved".
