Comair, flight attendants get more time to talk

NEW YORK, April 10 (Reuters) - A U.S. Bankruptcy Court judge has given regional carrier Comair and its flight attendants' union another week to try to reach a consensual deal on a new contract, a Comair spokeswoman said on Monday.
Judge Adlai Hardin was scheduled to rule on April 10 on a Comair motion, seeking the court's permission to throw out its contract with the flight attendants.




Remember, nobody wants to strike if they don't have to, but an acceptable TA has to be offered to avoid one. We are in the same boat.

Sexy Stews? Not at Comair anymore! Just a bunch of hags that found a job that over pays them to work 15 days a month. Comair used to be known for our Hotties, but now we have ex Delta FA's that took an early buyout or Seminole county (FL) cops! Sad...It looks like an old folks home sometime.
 
General what happened to the avatar? Too big for flight info? Couldn't make it smaller?

None of the Judges wants to rule on a new area of law. Aside from being difficult work, Judges hate to be overturned on appeal and this case (like the Delta case) will be appealed.

What I wonder is how ALPA is going to deal with the inevitable appeal. Politically, ALPA has painted itself into the corner with - if the contract is voided, we will strike. However, what if the Company voids the contract, but then does not act on it, or only makes small incremental changes? What if the matter is immediately appealed? Will ALPA tell its pilots to walk before any of us know how the appeal will turn out.

I'm starting to see a scenario where this who issue gets appealed and at the appelate level, gets kicked up to the Supremes.

ALPA fought a darned discovery motion for 11 years before the Delta pilot Plaintiff's finally got the matter to the Supreme Court. I'm sure everyone in the legal community is hoping that this issue is resolved by mutual agreement and after all, in 11 years, it probably will not matter, or the Judge will be retired.

In my humble opinion both the Company and the unions are correct on the law. The Company can toss the contract and the union can strike. However, there are a whole lot of people who would be negatively effected and the Court is going to try everything it can justify to avoid enabling the Company, or the Unions, to make good on their threats.

My crystal ball is saying that this will drag on for a long enough period of time that Delta's cash flow problems either are allieviated, or the Company goes Chapter 7 for "natural" causes. Here is where the employees are playing with fire. If concessions = survival v/s no concessions = certain death, what is the wining combination?

The Flight Attendants are being more conservative than the Delta pilots, which seems odd given how much the Delta pilots have on the line. General, is it your position that the Delta pilots are absolutely inflexible? If there is a middle ground the Courts are going to do their best to force you and your fellow pilots to find it - if for no other reason that the Judge will not go down in history as the "Charlie Bryan" of Delta.

I already gave a brief on the RLA and how it realates to a strike, and how that is the company's excuse. The Federal Courts will not stand up for that, and these statements are relevant:

"As the Supreme
Court has noted, “if the carrier is free… [to] resort to self-help, the union
cannot be expected to hold back its own economic weapons.”


" Similarly, if rejection is equated with Section 6 exhaustion, it is
equally clear that the employees would be able to strike in response to the
employer’s unilateral action."


It can be appealed all they want, but if anything changes (like scope)--we will walk. They know that. They really should NOT test us, because we are really ready. We have given enough, and we are NOT flexible on a few items--like continued pay cuts, scope erosion, and lack of pension credit. No flexibility there.
