Does anyone know the latest status of the COMAIR/ALPA or ASA/ALPA lawsuits? The last I heard was the judge in the COMAIR case found sufficient evidence that ALPA breached their duty to represent the COMAIR pilots but I have not seen any indication that the trial has actually begun.
Thanks

Last year Judge Glasser summarily dismissed 9 out of 10 RJDC claims. The judge did, however, decide that he has subject matter jurisdiction on the duty of fair representation claim and he will hear arguments on the merits, or lack there of, after the discovery phase. A union fails in its duty of fair representation when it acts in bad faith ( dishonest, fraud), discriminates, or acts in an arbitrary (so far outside the wide range of reasonableness as to be irrational) manner. Historically, most DFR cases fail to meet their burden.

One year after the last judgement the RJDC is still in the discovery phase of their last remaining claim.

Thanks, Looks like ALPA is dragging it's feet and this thing is stuck in discovery as best I can tell. Anyone have more updated information it would be appreciated, otherwise, thanks for the link.

Luckily for the Comair pilots, ALPA has been giving them plenty of ammunition lately. I wish them luck.

Yea right. ALPA is dragging their feet because they don't want this to go to trial. Like YOU conveniently disregarded, the judge has summarily dismissed 9 of the 10 claims.

So go ahead and believe whatever crap the RJDC puts on their website. (I have a few more websites you can visit, since you will evidently believe whatever you read on the internet. There's some really neat stuff out there, you know.) Contribute and say goodbye forever to your money, as you will see NO benefits. And if they win, (which has about .001% chance of happening) then say goodbye, period.

Wait. I guess you want a career at a REGIONAL airline. OK then. You can be like the other RJDC lifers. I mean, losers.

At least you have your aim set high once you get out of that 172. Wish the RJDC luck. They need it. Then maybe you can fly one of those shiny RJs someday, too.

I'm still waiting to hear what region Comair belongs to. Or ASA, or ExpressJet, or Eagle.

Regional Airline???

....that region would be the NORTH AMERICAN region, not to mention Canada, Mexico and Caribbean. But hey, we are just a bunch of brainless Commuter pilots who have no education and too many DUI's to EVER consider working for a "real" airline.

The bitterness of the mainline pilots on this board smells more like fear. You guys make is hard to have any compassion for your crumbling legacy carriers, and your plight.

1. I have a career at a REGIONAL airline, we have this pathetic pay because hypocritical losers like you agreed to every POS contract that was put before you to get to your major airline job, The current regional pilots are simply living with the crap that was left behind by the generation that went before us. YOU have more to do with the POS contract at the regional you came from than most of the pilots their now.

2. You have no idea who I am, I don't feel the need to post my entire resume on this site, I have nothing to compensate for.

3. I hope your pilot group shows as much profesional courtesy to it's regionals as you are here. If things keep going the way they are, you may be begging for date of hire on their seniority list...I'm sure they'd gladly staple you.

Probably the most important one though. Comair/ASA has just got to win one, ALPA has got to win them all.
