I guarantee I'd pass the second time -- or shoot myself.
I was crushed when I got 86% on my instrument written-- seriously I was in a bad mood all day, my Instrument checkride got a bit hairy on my ILS thanks to The summer updrafts in Pueblo, but I made it and didn't get a pink slip.
I hope I never have the misfortune to fail any checkride, but if I do, I don't think my firstr question would be to find a different examiner.
A work with a DE here in Memphis and there was student who wanted another DE to finish up his checkride. Dave told him he could do it, but he would have to pay another 250 dollars for the checkride. Which he did and passed.
So the moral of the story is that you can go to another DE, but you will have to pay the fee all over again.
