Did some R&D on background checks in my state (SD).

Talked to a State’s Attorney and he walked me down to the Clerk of Courts office, they kindly printed out a dozen or so pages of everything I have ever done. Traffic tickets, warning tickets, Possession of Alcohol by a minor. And the shining star that I had forgot about. INDECENT EXPOSURE AHHHHHHHHHHHH.

I was at a party when I was 18 and the Sheriffs Dept showed up and when the y pulled into the farm they flashed the flood lights on about 10 of us urinating alongside a barn.

Pretty innocent, but that title makes me look like some pervert that stalks grade schools in a Dodge van with blacked out windows.

The state’s Attorney told me that anyone with $15.00 dollars can get a copy of your rap sheet, as it is public information. He said this is not that same as the rap sheet the police dept keeps on you. This contains only charges and convictions. He also noted that when hi profile employers request a copy of this they only request convictions. He told me that is why they ask what counties you have lived in, as they will contact the Clerk of Courts Office for that County.

Bad thing in SD is that all counties, in which you received a violation, will transfer the offense to the Clerk of Courts office in which you reside. Even if you went to court in another county. I have gotten tickets outside my state while traveling, but they are not listed.

He told me that most States just let the offense reside in the county in which it occurred.

Would you know who does the actual checking of your records, does an airline employee conduct them all, or do they contract a service from a separate entity to complete these checks?
And if the checks are done by a separate paid party, can you give the name(s) of these companies so I can do my own check from the same source as the airlines.

It says 5-6 weeks, but I got mine back in 2 weeks. This was last year. I sent for it before applying for a federal job...and...SUPRISE! A speeding ticket I had forgotten about, when I was 16. Good thing I got it - I had to list all traffic violations on the application(even as a minor, with no time limit as to how far I had to go back).
 
Was your minor in possesion considred "youth full offender status"My friend was 19 and got busted. He has done the back ground check, $15.00, and it was not there. He contacted the clerk where he was busted and was advised that his case was youth full offender and that is was a sealed case.

The only way, according to the court, an employer or even himself could find a record of his bust was to go through a judge. The advice he has recieved from his attorney buddies was to check no for any misdemeanors as even the FBI backgound check will not reveal a sealed case.

If he admits to the crime and the HR dept. has no record there could possibly be a mark against him as he tries to explain a situation which in their eyes does not exist.

You should read the multiple threads about this in the General forum. More than one of us here has discovered that your employer will, indeed, find a record of a sealed case, and any other case lurking out there. PM Surplus1 and he can confirm, also.

The bottom line is this, and this is from personal experience, and the experience of others ... if you have ever been so much as arrested (and not necessarily even convicted) for any reason, at any age, in any state in the US, it can be, and will be found, easier than you think. Many of us here have learned hard lessons about this.

Check that infamous NO box at your own peril if you think a PJC, deferred prosecution, or conviction as a minor will not show up at your airlines HR department.

Thanks for the advice, my friends is upset now and wants his $15.00 back.

The other post do indicate a different story than what he was told by the court, attorney, detective, and FBI background check.
He wants to do the right thing so he will admit to his scratched record, it is just weird that he was advised to lie in the first place by the law upholders.

What kind of back ground check do airlines use that is more specific than a FBI check?
 
What if you had a ticket years ago and went to traffic school so it would "go away" and you called and the state DOT had no record of it. Would you still report it?

How many speeding tickets too many over a 15 year driving record?

Can this type of thing show up by the background checkers?

Well, like I mentioned, ANYONE can go to the Clerk Of Courts office and for $15.00 request the complete court records of ANYONE. This will be the clerk of courts in the county that you live.

This is a list of all CHARGES, CONVICTION, etc.

Here is an example of one of my offenses:

DATE: 11/04/1998 COUNT: SPEEDING ON OTHER ROADWAYS

DISPOSTION: Judgement of plea of Guilty.

FINE: $33.50 JAIL TIME: NONE

SUMMARY: Convicted of speeding on gravel road (40mph in a 30mph zone).

I have seen application that ask you to list all offenses, or some ask for just convictions. The clerk of courts can print a record of just convictions or a record of all charges.

These days most companies (at least the airlines, as required by the TSA) require you to disclose ALL charges - not just convictions. Don't be fooled...traffic school doesn't wipe out the charge. Remember, airlines not only get a background check through county records, but they also get an FBI report. :eek:

So what should be the average or normal for a past record. Are only the perfect specimens getting jobs or interviews?

After reading my "rap sheet" I felt like a scofflaw. No DWI, DUI, careless, reckless, no criminal stuff, never touched a drug in my life. But lord forbid they catch you doing 40 in a 30. I don’t know any pilot that does not live large, skydivers, racecar drivers, aerobatics, motorcycles, the list goes on and on.

So after you list your multiple speeding tickets, seatbelt tickets, minor alcohol possessions, do the airlines just put your app in the garbage?

I used to work at a major and the company sent me for an expensive training for an operational class. While on my last day of training, i came back and gave my two weeks notice in. A week later, the manager told me that i was suspended until further notice for a week. I only had a week left. She made a charge that i wasted company time and money. I agree with their concerns but i never knew that a certain company would hire me. I stayed professional and game my two week notice but they didnt care. Now they said that i am not-rehirable. I am afraid that during my background check, i will get a bad recommendation from a previous employer. I have worked for approximately 7 companies and this is the first time where i am not rehirable. Should i be worried?

Again, ms clark....congrats on the job.
