Gorilla has nailed it.

After listening to this debate for some time, this makes the most sense. This is the only case scenario that resembles a "Win- Win" situation.

Personally, I would like to see the rule stay for all the reasons that have been stated repeatedly, but if it does change this idea would be somewhat palatable.

1.FARs are more for liability than safety as they are usually driven by an occurence.

2.The original article covered PT91 pilots ie:single pilot, a BFR every 2 years and medicals just as infrequently - not the PT121 rules we have to abide by, plus the fact that there is someone qualified next to the "old guy".
