ASA and the 80%

[FONT=&quot]The 80% for ASA in Atlanta was to protect Skywest Inc from having mesa, chq ect. take over Atlanta. Delta is not going to say wait a minute you can't bring Skywest Airlines to Atlanta because ASA will not be 80%. Skywest Inc would have to say something and because they would be the ones replacing us with Sky airlines I doubt they would.[/FONT]

Doesn't matter, DL is in bankruptcy. All they need is the courts approval and they change the contract to fit within their reorginization plans. If DL shows the court that the current contract no longer fits within their plan and will hamper their ability exit bankruptcy, the court will give DL what it wants. I would be surprised if JA has not talked to the DCI managers about contingency plans in case we even get close to striking. But if I where a betting man, I would bet we won't get close.

I hate to say it, but given the current state of the regional industry, we're screwed. Business 101, to much supply for shrinking demand.

I like the idea of that 80%, 'cus it makes it sound like we have something to depend on. But......

As that was a contingency for SkyWest (and I believe it was to secure the last 100 mil or so on the deal), and not anything that Mother D necessarily wants.... Whats to stop JA from going to DL and saying "You remember what a bunch of f'wits these ASA fellows are, they're giving us all these problems, how about we just forget that 80% deal, and here's what we'll do for you with the new and improved SkyWest Airlines (Southeastern Division)"?

Im dont think DL would be too broken up about changing those terms, and I bet JA would be willing to make them some kind of deal to get it done- if it he thought it was in HIS (inclusive of Management/Shareholders) best interest.

I dont know if the pilots/union would/could have any input on this, but it doesnt seem too much of a stretch that the 2 bound parties (DL + SW) would be able to circumvent this without breaking a sweat.

I think we're getting and going to keep getting the pimpstick. Life's not fair and that's just the way it is.

Leroy, I don't think so! Skywst does not have a prayer in filling our HUGE presence in ATL. It would cost Delta so much money to try and "cover" our flying, all of which, would be STRUCK WORK, so that wipes out Mesa, Chtq and Comair! Not a Chance!!

The aggreement that gave ASA the flying was a bankruptcy approved deal and very hard to change. That's what the 125mil in escrow was for; to guarantee that DAL would not change the deal as part of its BK filing. Once the court sealed the deal as it was negotiated, SKW gave DAL the escrow money. It wouldn't be impossible to change it, but it would be difficult to change a deal previously approved in BK court.

You could be sure that if DAL did SKW a favor by going back to the BK judge to change that part of the agreement, DAL would want some other concession for it.
