"WHO" is ALPA???
I've read the compaint. And while I don't mean to ignite a legal debate, given my observations regarding the perpensity of ALPA National to display enormous arrogance and contempt toward certain groups of dues paying members, (i.e. "playing favorites"), I think someone needs to bring this thought to their attention.
I was unaware, and I assume it's true, that "("ALPA"), is an unincorporated association and labor organization" as set forth in the complaint. The key word is UNINCORPORATED!!!
Most of us realize that the basic idea of a corporation is to absolve persons associated with that corporation from personal liability. If the organization is unincorporated, the members of that organization enjoy no such shielding of personal liability. In my view this means that all of the owners of ALPA National could be held individually accountable for the actions of this organization. The question then becomes; who are the "owners" of ALPA National? Senior ALPA management? ALPA directors? MEC's? Or each and every member pilot??
And while I would like nothing better than to see Captain Worthless held personally responsible for any judgements in excess of funds available from the union's cauffers, I think that all ALPA members should seriously consider their personal liability in this, and other actions currently pending before the courts, (i.e. R.J.D.C.).
Someone needs to have a candid conversation with the leaders of this union and make them understand that they are not bullet-proof. ALPA National is deeply mired in numerous conflicts of interest. They should admit that those conflicts exist and seek to resolve those conflicts before proceeding by playing favorites. A good start would be to admit that ALPA "may have" screwed up in the handling and resolution of the TWA/AA integration and seek to resolve that issue fairly. But I won't hold my breath.
