How many DFR suits has ALPA been involved with in the past twenty years? What is their record in regards to wins/losses (settlements to be included as "losses")? Who were the parties? Which ones, if any, are still pending (aside from the TWA pilots)?

Little birdy told me that ALPA got it's butt handed to them by the Judge in the TWA suit today. Sure hope so. Any truth to that?
 
ALPA lost BIG Time in the Duke V,. Spellacy DFR about 12 or so years ago. They finally prevailed after Zillions of dollars in legal cost, when the Supreme Court got involved. Some of the plaintiffs settled before hand for a considerable sum.
They are about to get sued again over the claim payout where they decided to not fight the termination of the retirement plan in return for a claim payable to the pilots upon BK exit. Delta's unit of ALPA then decided that those who retired without their lump sums, would forfiet their share and it would be distributed to the pilots currently on the property. I suspect that the individual MEC and ADC members will also be sued INDIVIDUALLY under the Racketeering Influenced & Corrupt Organizations Act.
By the way, If they are sued as individuals, ALPA by law cannot use it's funds to defend them. NO INDEMNIFICATION. ALPA never tells new officers that. Perhaps they would not be so cavilier in their decisions if they did!

Actually, our web guru has been busy doing other things and nobody's taken the time to find another one. It's way down there on the list of priorities since many of the TWA pilots are on the twapilot.com site and most of the information is relayed to them there.

ALPA keeps getting backed into a downhill corner that gets darker and darker. When will the membership start asking questions?

Actually, ALPA always tells new officers that. That's the reason that many reps decide to purchase their own insurance to cover such cases.
 
stlflyguy, ALPA has one of the lowest incidences of DFR suits per capita in all of organized labor. Do some research into how many people file DFR claims against large unions like the IBT, UAW, etc... They're constantly battling these cases.

Maybe there'll be some crumbs left over after TWA's done with them. (I hope not! ;) ) TC

So did ALPA lose or did ALPA prevail? If memory serves me right the only plaintiffs that got a dime were the ones who settled with ALPA, the ones who stuck it out in court got zilch.

Since when was the Claim ever tied to the loss of the defined benefit plan? When you get your facts straight feel free to comment some more.

Delta's unit of ALPA decided that your claim payout should be commensurate with the level of your concessions under LOA 51.
