Depends on the contract. Most of the time it would be the organizer that owns the rights to the show. EAA sometimes sells their own video of Oshkosh and Sun-n-Fun so being that they derive a profit from selling these videos they may not take kindly to people selling similar videos without paying for licensing. If a performer doesnt sign away the rights of their performance they would be entitled to defend their performance as a copyrighted work. Either way it is considered a work such as a book, movie, etc and covered by copyright laws.
