I can think of numerous cases were a pilot was flying under a class 2 medical and the EU had a problem with it even though it was P-91

No, they do not have a problem with it. What they have a problem with is guys flying with an "expired" class one medical that is still a current class 2. If there medical says "class 2" then it is OK (part 91).

In their eye's it is an expired medical as they do not have same expiration rules that we have here in the states.
