US Airways Local Council 41 Put in Trusteeship
Executive Council votes unanimously to remove officers for failing to provide necessary support to ALPA
March 3, 2008



The Executive Council voted unanimously today to take “emergency corrective action” by placing Local Council 41 (US Airways, Philadelphia) into emergency trusteeship.
The vote terminates the terms of Capt. Eric Rowe, chairman and captain representative; Capt. Dave Ciabattoni, vice chairman and first officer representative; and Capt. Jim Portale, secretary-treasurer. ALPA President Capt. John Prater appointed Capt. Clyde Romero and Capt. Jack Lawrence (both members of Council 41) to serve as trustees of Council 41.

The president instructed the trustees to fully represent the pilots of Council 41 in all matters pertaining to their membership in ALPA. The US Airways MEC will continue to make all decisions concerning the affairs of the US Airways pilots.

Although no hearing is required at the Executive Council level, the Council offered the three former officers the opportunity, which they declined, to make a presentation, either in person or by telephone. A full hearing before the Executive Board will be held within 30 days to formally consider the charges and allow the three former officers to present their views.

The Executive Council found that the three local council officers demonstrated a pattern of support for a rival union in the upcoming NMB representation election, including distributing anti-ALPA communications through ALPA channels and failing to provide necessary support for ALPA in connection with the NMB representation election.

The president asked the three former officers specifically to confirm that they support ALPA in the representation election, that they oppose USAPA in the representation election, and that they will urge the Local Council 41 members to vote for ALPA. None of them would make such statements.

Why now?

Simply put, the Council 41 officers have consistently failed to confirm their support for ALPA in the upcoming election. When asked by Capt. Prater, the three officers failed to say that they stood behind their union and support a pro-ALPA vote.

Last Friday, Capt. Prater sent the three Local Council 41 officers a “Notice of Charges and of Executive Council Meeting to Consider Charges Pursuant to Article XIX, Section 1.D.” The Notice was the basis for emergency corrective action in the form of a trusteeship as provided in Article XIX, Section 1.D of the ALPA Constitution and By-Laws.

Capt. Prater requested the Local Council 41 officers send written statements to Vice-President Administration Capt. Bill Couette making clear their support for ALPA and opposition to USAPA in the NMB representation election, and their commitment to urge Local Council 41 pilots to vote for ALPA. While they did email a response to Capt. Couette, they failed to make the commitment to state their support for ALPA and against USAPA.

“Many of you have urged me to take this action for many months,” Prater wrote the Executive Board on Friday evening. “I had hoped that these three elected officers would stand up for their union. However, with the NMB representation election for US Airways pilots beginning on March 20, the stakes are too high for US Airways pilots—and the actions of these officers far too hurtful to our union—for me to delay further.”
 
Well done. I'm not a big Prater fan, but he did the right thing in this case.
 
Yea taking away a local councils elected reps, that is some union. Meanwhile CLT still has not scheduled the recall.

So according to ALPA, elected reps held in high regard by their constituants get removed by would be dictators from afar and yet another council who's constitiuants want a change cant get it.

I did hear a rumor that the CLT reps are planning to actually have their 1 month past due quarterly meeting next month. I am sure the timing of this is just coincedence.

Should a criminal who is held in "high regard" by people be forgiven his crimes and receive no punishment? These reps may be held in "high regard" by the uSAPa saps, but they are in breach of their duties under the Bylaws. As a result, they were removed from their positions. Anything less would be irresponsible (and illegal) behavior on the part of ALPA National.

Maybe if someone reads the Bylaws they'll be able to figure out how to get the change they're looking for. I'm sure out of hundreds of pilots in CLT, somebody knows how to read and comprehend the Bylaws.

I believe this is the best thing to happen in the AAA/AWA situation in a very long time. It's just a shame that it couldn't happen sooner. Now if the AAA pilots were smart, they'd drop this uSAPa nonsense, drop the lawsuit, recall all of their reps, and replace them with new reps that could work with the West to come to an amicable solution.

You are not at Airways and yet you somehow know all the inner working of what is going on in PHL and CLT.

Since when is an Oath to Prater required by the by laws? The PHL reps have done nothing wrong other than to disagree with the crap that ALPA is dishing out. They have worked under the ALPA rules to try and represent the PHL pilots. Well I guess the next "bribe" will be coming down the pike any day now, and Prater can not have anyone on the Airways MEC that might not take the bait, so they are gone.
The very fact that you support this without question says volumes.
 
Using ALPA resources to promote the cause of USAPA is a complete violation of the ALPA bylaws. The dues money of hard working ALPA pilots was going to these clowns to undermine everything ALPA stands for.

An ALPA representative is not only tasked with representing the rank 'n file, but as well, to represent the organization of ALPA. Doing otherwise is grounds for dismissal.

This is the problem, they did NOT use ALPA anything to promote USAPA.

Prater trumped up false charges, replaced some of the best pilot reps USAir pilots have ever enjoyed, won't even allow them to have a hearing on the false charges until 30 days after they are removed, and all while the union is in dispute.

Prater also did this immediately before the reps are to elect the MEC and committee members. Prater has stacked his deck to control the vote of who will be the MEC, JNC etc. Once again ALPA denies pilots the right to decide. ALPA is in full rebellion against its constituents.

Prater is the best thing that ever happened to drive pilots away from ALPA and he keeps getting more aromatic with age, like a hundred cats that urinate on your rug or like fifty dogs that defecate in your living-room.

Compared to Prater, Dougweiser is a saint, Carl Ichan is an alter boy, Lorenzo is a boyscout, and Jonathan Ornstein is a cherub. May Prater live long and flourish at ALPA, like the odor in your rug!:beer:

From and outside perspective, the deal sucked for US Airways East guys. Unfortunately, your company went into bankruptcy not only once, but twice. I think most there are lucky to have jobs. Still just a bad situation for you guys.
