You land safely at an airport, the plane before or after you crashes...feds pull your Cockpit Voice and Flight Data recorders.

Can they do that?

Yes. NTSB can. FAA cannot use the transcript or data to initiate enforcement against you. In theory.

The company can. Most major airline and better regional contracts contain provisions againt company use of CVR against flight crew and for representation upon any access to said recorders.

I assure you that our company is not going to use the information from either CVR to hang either crew. Since two sister ships were minutes apart on an approach and the first one didn't make it the NTSB felt it worthy to hear what the "surviving" crew was saying during the sequence. Mostly looking for comments about wind shear, birds, ice, etc... that either pilot does not recall saying while watching their friends go in. You can't always trust someones memory to tell the whole story. Call it thinking outside the box on the NTSB's part, no pun intended.

I was surprised too but after some thought I think it's the right thing to do as we are still without a smoking gun.

Excuse me now as I'm off to the co-pilot's visitation.

Whatta week............

Our checklists must be different......

Ours say........

Master Warning Illumintes......

Clear CVR
step two
Clear CVR
step three
Clear CVR
repeat

i think he was poed at a bunch of conservatives. he really screwed everyone over in my grandparents farmtown by buying 12,000 acres at 3x what it was worth nearby so everyones taxes went up and the town is about to shut down thanks to him.

Yes, if you go check the latest news on that story, the feds pulled the sister ship's data recorder(s).

Only if you are a cheese head.

In the course of an investigation, NTSB has almost carte blanche (sp) as to what information they can access. The possible scenarios are infinite but all things being equal, the short answer to the original question is: Yes.

The long answer is NTSB (these feds) can pull the recorders, but FAA (those feds) are prohibited by the CFR to use the information contained therein to initiate enforcement action if there was no prior knowledge of an infraction.

In theory.

I already say it was 99% chance of being icing, from what I hear the C560s love to stay airborne and with wx that day it has to be the cause. Any idea on what the popping noises we're that were heard though? Im thinking maybe ice going into 1/both engines and cuasing a flameout?
