Is it correct that commercial aircraft below 12,500 MTOW are NOT required to check pax against the TSA's NO Fly List?

True. They changed the definition of 12-5 Security Program requirements in summer of 2004 from inclusive of 12,500 lbs to over 12,500 lb which corresponds to FAA categories.
