Is the total time flight time limitations and rest requirements of the Captains at TAB, when working as a CFI, count towards the 1,000 hours in any calendar year, 100 hours in any calendar month, 30 hours in any 7 consecutive days, per FAR 121.471, or FAR 121.517? If they are working a a Captain at an airline, is the flight time at TAB count also?

FAR 121.471(a) No certificate holder conducting domestic operations may schedule any flight crewmember and no flight crewmember may accept an assignment for flight time in scheduled air transportation of in other commercial flying if that crewmember’s total flight time in all commercial flying will exceed.
(10 1,000 hours in any calendar year;
(2) 100 hours in any calendar month;
(30 30 hours in any 7 consecutive days;
(4) 8 hours between required rest periods.

The key words that I question are: “in other commercial flying”. Is being paid as at CFI at TAB considered commercial flying?

I think I'm the only "active" airline guy that does occasional CFI work for TAB. There are several furloughed guys from Delta and Northwest, and an active Northwest guy that does only simulator instruction. There are also a couple of retired airline pilots, and at least one that used to work for a regional.

The time is all part 91 flying (part 61 instructing, but none of the King Air flying is leading toward any certificate). I would certainly imagine it to be "commercial" in nature, cosidering you're getting paid to do it. The only time constraint that is even close to being a player is 30-in-7. I fly there a couple of days a month. When I instruct in the simulator, that's not a factor. If I do a "familiarization" flight where it's one-on-one me with a student, I'm sitting in the front and logging CFI time for 2.5 to 3 hrs. If I fly a x-ctry LOFT flight, I'm up front for about .2 per leg (i.e., about .4 hrs in a 4 hour flt which consist of 2 legs).

When I get paid for 75 hrs/month by my airline, I'm only flying probably 60 block hours, so 100 hrs in a month or 1000 hrs in a year are not factors. So, if I fly 4 or 5 hours with TAB per month, I just have to make sure it's not creating a 30 hour in 7 day problem.
