You're right. It was thread creep.

The regulation itself only says two things:

1. An examiner is not PIC for the flight unless he specifically agrees do so.

2. Not being rated in category or class does not preclude a pilot from carrying passengers (namely the Examiner) during the checkride.

The'yre really to sides to the same coin, and the "applicant as PIC" more or less a necessary result. =Someone= has to be acting as PIC. If it's not the Examiner, it's got to be the applicant. All the second part of the rule really does is authorize a pilot who is only permitted to act as PIC in solo flight to carry a passenger. But that doesn't give the applicant the authority to do something otherwise prohibited by the regulations, like act as PIC on an IFR flight plan or in IMC.
