Headed eastbound today through Toledo approach's airspace and a Netjets airplane was being vectored for the approach into Detroit City (DET) but could not accept the vectors because it would take them through Canadian airspace. It was amusing because the Toledo controller was getting p*****, because Detroit wouldn't even accept the hand-off. Finally it was somehow worked out, but they still didn't take vectors through the Canadian airspace.

What was going on???

Its a rule that someone at NJA figured out a few years ago (not a new rule, it was just kinda discovered one day) where they figured if a temp registration couldn't leave the country then that includes 12 miles from shore or overflight of Canadian airspace flying into Detroit.

Does anyother operator recognize this rule? I would really doubt it. I do not believe our sudden compliance was due to enforcement action or anything like that. I think it was a company book worm who made a "find" and got policy changed.

I would have a lot of other things to worry about before I worried about this little rule. I am surprised people are actually paying any attention to it.
 
I believe if ATC puts you over the airspace for their own convenience ... I would not worry about it.I had a water route from Dominican Republic to Houston. Because of T-storms and a real mess with traffic. ATC eventually sent us to PSX then on to HOU. As you know... that is normally a Customs no no.
