my 15 day suspension !?

my attitude may seem like i'm proud of my 15 suspension today, but I'm not.

(last jan 3 i flew cargo for hire in a part 91 plane that wasn't 135).

the FAA had 6 months to take enforcement action and July 4 i breathed a sigh of relief. but today FED EX gave me a 15 day suspension letter, post dated July 3. I only have another week of suspension.

should i agree and sign and return the suspension letter, or fight it ?

could i have future job application problems if i do?

You really owe it to yourself to fight your suspension. You should find an aviation attorney to help you.

Let's say that the FAA is dead-to-rights on your situation. A good aviation attorney can minimize its impact on your FAA record. You might have to pay penance in some form, but it would be worth it if you can avoid a large blemish on your record.

You have no choice but to sign it. If you wanted to fight this then you should have done so at an earlier date..

I'm taking Aviation Law through Riddle at the moment, and this is one of the subjects covered. Pick up a copy of "General Aviation LAw" by Jerry A. Eichenberger. It's part of the Practical Flying Series published by McGraw Hill. It has a chapter on FAA Enforcement Actions and Pilot's rights. I've seen it in Borders and Barnes & Noble. Basically it will tell you to get an Aviation ALwyer, but it does give a good overview of the process so you know your rights.

From what I have learned your first notification from the FAA should have been a Notice of INvestigation. The pilot has 10 days to respond. The next step is the LEtter of PRoposed Cert. Action, which must be sent out within the 6 month time frame. After that the FAA will send the Notice of Certifiacte Action, putting the suspension into effect. If your certificate is currently suspended did you not receive the other notices?

If your certificate has been suspended, act quickly. You have 20 days from the date your certificate is suspended to file a Notice of Appeal with the NTSB.
 
i got a registered letter late last january (an LOI)

i then talked to some attys, etc and also my boss seemed sympathetic (ie. his atty would take care of it- i know, i know don't trust your boss's atty).

i'm surprised they didn't have to send me a registered letter today - (my landlord signed for the FEDEX letter and he gave it to me)

ultimately, i thought i was off the hook because my boss told me by phone a t 5 AM to take the plane that i did - implying that it's OK

(our island bound cargo was stamped; urgent medical supplies. - what am i supposed to do then?)
 
Sounds to me like your employer should have been the subject of enforcement action also. Make sure you appeal with the NTSB!
 
1. Get an atty and fight to the last. Sell out your employer if necessary. After all, even though it was your decision, he coerced you.

If that doesn't work then;

2. Take your lumps. You Fu*#ed up. What have you learned? That will be your story in the future interview. Almost every pilot has screwed up at some point.

I think we went through this before. You should have got a lawyer and LAWYERED UP!!

The FAA has no interest in anything but to violate you. Anything you say or do is used against you!

yoyu screw them around. You delay them. You agree to an informal conference in an office IN PERSON and at a different FSDO. You get the FSDO handling the case changed to another office!!

The rest of you.....TAKE NOTICE!!!!!

These guys are mean, unfair, and dont play by the rules. Do not trust anyone but yourself and COMPETENT COUNSEL!!!
