Judge: Bankrupt NWA partner may not impose terms
In an interesting airline bankruptcy twist, a U.S. District Judge voided Mesaba Airlines' power to impose concessions on its unionized workers. The Minneapolis Star-Tribune (free registration) writes that District Judge Michael Davis “determined that U.S. Bankruptcy Judge Gregory Kishel erred in mid-July when he granted the airline the authority to nullify existing labor contracts with its pilots, flight attendants and mechanics.” Davis’ ruling came after Mesaba’s unions appealed the bankruptcy court ruling, and the Star-Tribune writes that the District Court judge “decided that Mesaba didn't negotiate in good faith and failed a legal test requiring it to be ‘fair and equitable’ in spreading the pain of its bankruptcy restructuring.” Now, the paper says Mesaba is left with the “two immediate options”: liquidating, or negotiating new deals that union workers would be willing to ratify. Mesaba is a regional partner for Northwest, operating feeder flights for Northwest at its Detroit, Minneapolis/St. Paul and Memphis hubs.
