Anybody familiar with FMLA?

I understand that I am protected under law to take up to 6 weeks unpaid leave for the birth of a child after I have been employeed for at least one year, and may be taken at any time up to one year after the birth. If the baby is born before my one year anniversary, am I able to take a leave after my one year anniversary as long as it hasn't been past one year after the birth. If someone could provide a reference that would be great also. Thanks!
 
Do you use your computer for anything other than Flightinfo?

Synopsis of Law

Covered employers must grant an eligible employee up to a total of 12 workweeks of unpaid leave during any 12-month period for one or more of the following reasons:
  • for the birth and care of the newborn child of the employee;
  • for placement with the employee of a son or daughter for adoption or foster care;
  • to care for an immediate family member (spouse, child, or parent) with a serious health condition; or
  • to take medical leave when the employee is unable to work because of a serious health condition.
 
Thanks for the response. To answer your question, yes I do use my computer for other things than flight info. I have seen that website. But my questions was not clear on the website you provided when I looked at it earlier, or when you refered my to it just now. At the time of the birth, I was not eligible for leave. I am now eligible to take leave and it has been within twelve months since the birth of my child. Am I covered under FMLA?

And by the way, are you always such a jacka$$? oh...just looked at your other posts...you're a regional pilot! No wonder...your life sucks!

Yeah i think its 12 weeks though not six.

I was on it when my dad got sick. Worked out great. I don't know if you're covered after 12 months of the birth of your child though.

Glad to know that you learned so much about me by 1 post. And BTW I am very happy with my life. 1 wife, 2 kids, decent job, my life is pretty good.

If I have offended you in some way I am sorry. One of my pet peeves is people that ask the same question over and over again without taking 30 seconds to search for the answer themselves. If that is not the case, again I am sorry.

Not being a FMLA expert, although having used it 3 times let me say: I don't see when the birth of the child has anything to do with it. If there is some need for you to be home with the child at this time and you are eligible, you can request up to 12 weeks leave.

Why not ask the HR department were you work & see what they tell you. They may say yes, end of discussion.

Oh, congratulations on the baby. I hope that all are doing well.

Yes... you are eligible. The key is that you have 1yr when you make the request for time off... for an eligible matter.

I am no expert on it but I believe I read somewhere that your company also has to have 50 or more employees in order for you to be eligible for FMLA.

If your company employs more than 50 people, you are eligible for twelve weeks. If you company employs less than 50 people, you are eligible for six weeks.
