I wrote earlier about my felony conviction and was told last month that i did not pass the test. My 10 year anniversary is next week (aug 2, 1993) and my employer told me to go retake the test on aug 3. I was honest with them and they did not care until my TSA badge failed. I told the fingerprint "cops" that i will be retaking it and they said that since i already failed once, i can not retake it till i show them that the record is removed. Do i have rights and how can they deny me to retake the test? I told them that the proof is in the dates and they would not accept that. Is there someone i can call at the TSA or take a preliminary test in a different city?

I have rights and i dont think they have the right to judge me if i have not broken there regulations. If it is over 10 years by couple days, does the conviction still show up?

Unfortunately, I believe they can do about anything they want, without much recourse left for the victim.

You may not have to retake the fingerprints. You will have to appeal. We had a pilot that failed. He appealed and then was passed. What had happened was that a person with the same first and last name, but different middle name had a criminal record and madeup several social security numbers to use. One appears to have been close enough to cause our pilot to fail.

Good luck.

what a load of $hit... you gave up a bunch of "your" rights when you became a CONVICTED FELON, by breaking "there/their" regulations. (It may not be fair, but life isn't fair...)

get a attorney and try to have your record erased, it can be done.
