The aircraft I fly cost about $5,000 per hour to operate, so what you are saying is that if I have only one person on board, I have to fork over $2,500 per hour for my share.

If owned the bonanza, I could hire any commerical pilot to fly it, you are correct, the would be private carriage. He could fly me around all day long and not think twice about it.

The difference comes in the definition of Private and Common Carriage. If I buy a Gulfstream for my company and keep only my employees on board the plane and a FEW SELECT partners, then the whole operation could be done under part 91. As soon as someone who is not mentioned in the agreement the flight becomes Part 135 and it would be illegal for me to fly it.

That's just not true. You can carry anybody you want in that gulfstream (or bononza, but you can't charge them for it). If you have a client you want to go get and bring to your company HQ as a display of dazzle and flash, then go for it. There is no list or "agreement."
 
Ok, after rereading this thread about 8 times, I know where I screwed up.

In this quote I forgot to mention that I am charging my 2 buddies for the use of my airplane.
If I came up to you and said I want you to fly me and 2 buddies in MY Bonanza to Lake Tahoe to go fishing. If you accept you are conducting an illegal operation unless you pay your pro rata share of the flight.
In this corrected situation, I as the owner of the airplane and you as the pilot, would be illegal. Correct?

I didn't state it before because I thought it was assumed that I would be making money in all the situations that I posted. I know that I can do anything I would like to do with my airplane or my companies airplane if I am not making money off of it.

I apologize for all the confusion.
